The creators of popular online video game Fortnite claim Apple caused great competitive harm to iOS users in Australia when they kicked their game off the App Store.

Federal Court proceedings against the tech giant have begun in Sydney after the popular battle-royale game was removed from the Apple online distribution store in August.

Software developer Epic Games – which launched Fortnite in 2017 – responded by filing for court action against Apple in the United States.

The company also commenced Federal Court proceedings in Australia, arguing Apple's conduct violated Australian consumer law.

During brief proceedings on Tuesday, lawyers for Epic Games said Apple's conduct had caused 'great competitive harm' that had affected millions of iOS device users in Australia.

The court was told a jury trial in California was due to start next year.

Justice Nye Perram said there would likely be an overlap with court proceedings in the US that could be relevant to Australian competition laws.

He said the case would return to court in March or April, subject to the availability of legal representatives.

Epic Games claims in Federal Court documents they added a cheaper direct payment processing option for in-app Fortnite purchases on iOS devices in August.

Apple responded by removing Fortnite from the App Store and preventing further downloads.

'Further, Apple's conduct referred to in paragraph 7 above has harmed Epic through, inter alia, loss of goodwill in respect of both Fortnite, other Epic games on iOS devices, and Epic more broadly.

In November, Epic Games founder Tim Sweeney told News Corp the legal fight was not about money but forcing changes to the way apps were delivered to people.

In a statement responding to Epic Games, Apple has said their policies are there to protect consumers.

The company pointed to a judge's description in a separate US lawsuit of Epic 'clandestinely' adding the payment option, which it 'intentionally omitted' when seeking Apple's approval for the update that activated it.

'Our priorities have always been to provide customers with a safe and trusted place to download software and to apply the rules equally to all developers,' their statement reads.
